Condições de venda
Terms of sale
These terms govern every order placed on this site. They are written to be read rather than to be scrolled past, and the parts that most often cause a dispute — currency, delivery times, what stops a return — are stated in plain numbers.
Last updated 15 August 2026 · Governing law: Portuguese law
1. Parties and scope
These terms apply between PODER INFANTIL - INDUSTRIA DE CALÇADO LDA, with registered office at Rua Padre Pereira da Costa, 883, 3720-706 São Roque, Oliveira de Azeméis, Aveiro, Portugal, NIPC 507993373 (“we”, “us”), trading as Passinho at poderinfantilshoes.homes, and you, the customer.
Matriculada no Registo Comercial sob o número único de matrícula e de pessoa coletiva 507993373. Placing an order means you accept these terms as they stand on the day of the order.
Orders may only be placed by a person aged 18 or over. We do not operate customer accounts, and we do not knowingly collect data from anyone under 13.
2. What we sell
Everyday children’s footwear for ages one to twelve, plus insoles, a paper measuring gauge, replacement straps and a cleaning kit. Every product page states the three-row material composition, the five chemical restriction checks that apply to children’s footwear, the angle the sole bends to and the method it was measured with, the sole thickness, the weight of a single shoe, and the growing room the pair is built around.
Product photography is representative. Leather is a natural material and its grain, and the way it takes colour, vary between hides.
We do not sell orthopaedic, corrective or therapeutic footwear, and nothing on this site is a medical device. We describe structure, materials and numbers; we do not make claims about what any of it does for a child’s feet.
3. Prices, currency and taxes
- All prices on this site are in US Dollars (USD). There is no currency switch and no other currency is accepted.
- Prices include Portuguese IVA at 23 % where it applies to the sale. The invoice states the treatment that applied to your order.
- Orders delivered outside the European Union may attract import duties, customs charges and local taxes on arrival. These are payable by the recipient, are set by the destination country and are not collected by us.
- Shipping is charged separately and shown before you confirm. Standard shipping is $12 and is free on orders of $89 or more.
- If a price is obviously wrong through an error on our side, we will contact you before taking payment and you may cancel at no cost.
4. Promotions and discounts
First order code. We operate a single fixed code, FIRSTFIT, giving 10 % off. Conditions:
- one use per customer, on a first order only;
- applies to the goods total before shipping;
- not combined with any other offer or code;
- no minimum order value and no expiry date at the time of writing;
- it does not reduce or affect your right of withdrawal or the legal guarantee. If you return part of an order, the discount is recalculated on what you keep.
Reference prices. Where we ever show a previous price struck through, that figure will be the lowest price we applied to that item in the 30 days before the reduction. If a price does not satisfy that rule, no struck-through price is shown at all. This is enforced in the code that renders the page, not by a person remembering to check.
What we do not run. No back-to-school countdowns, no “buy the next size while it is cheap” offers, and no urgency timers. Those promotions push people towards buying a size too large, which is the one thing this shop exists to argue against.
5. How an order becomes a contract
- You add items to the bag, choosing a size from the measured foot length.
- At checkout you give delivery details and confirm you are 18 or over. Nothing is charged at this point.
- We record the order and give you a reference. A member of our team checks the foot lengths against the sizes chosen. If a size looks wrong to us we contact you before taking payment.
- We send a secure payment link to the email address you gave. The contract is formed when payment is completed and we confirm acceptance of the order.
- If we cannot accept the order — stock, a delivery address we cannot serve, or a suspected error — we tell you and nothing is charged.
We keep the order record even if payment is never completed, so that we can answer questions about it and so that you can ask us to delete it. See the privacy policy.
6. Payment and payment security
- Payment is by card. Cards accepted: Visa, Mastercard, American Express, Maestro. Availability of a given card brand may vary by country.
- This site is served entirely over HTTPS. Card details are entered on a PCI-DSS compliant payment page operated by our payment provider.
- We never see, handle or store card numbers, expiry dates or security codes. None of that data passes through this website, and none of it is written to our systems.
- Payment is taken in US Dollars (USD). If your card is denominated in another currency, your bank sets the conversion rate and may add its own fee.
- Goods remain our property until payment has been received in full. Risk passes to you on delivery.
- The name that appears on your card statement will identify this shop. If you do not recognise a charge, contact us at support@poderinfantilshoes.homes before raising it with your bank — it is faster, and we would rather fix it ourselves.
7. Delivery
- Dispatch: 1–2 business days after payment clears.
- Portugal: 2–4 business days after dispatch.
- Rest of the European Union: 3–7 business days after dispatch.
- Rest of the world: 7–15 business days after dispatch.
- Where no delivery date is agreed, delivery takes place without undue delay and in any case within 30 days of the contract, as Portuguese consumer law requires. If we miss that, you may set an additional reasonable period and, if we miss that too, cancel and be refunded in full.
- Estimates are for the courier’s working days after dispatch and exclude customs delays, which we cannot control.
Full detail, including what to do if a parcel arrives damaged, is on Shipping and returns.
8. Legal and export restrictions
- We ship to the destinations listed at checkout. We do not ship to countries or persons subject to European Union or United Nations sanctions, and we will cancel and refund an order rather than breach those measures.
- You are responsible for making sure that the goods may lawfully be imported into your destination country, and for paying any duty or tax charged there.
- Goods are supplied for personal, domestic use. If you intend to resell them, please use the bulk enquiry form instead, so that the labelling and documentation you need for resale go with the order.
- Our products are ordinary consumer footwear. They are not dual-use goods and are not subject to export control licensing.
9. Right of withdrawal
As a consumer you have 14 days from receiving the goods to withdraw from the contract without giving a reason. Shoes may be tried on indoors, on carpet, as you would in a shop. Outdoor wear on the sole goes beyond what is needed to establish fit and ends the right to return that pair.
The full procedure and the model withdrawal form are on Right of withdrawal.
10. Returns and refunds
- Refunds are made to the original payment method within 14 days of us receiving the goods back, or of you proving you have sent them, whichever is earlier.
- We refund the goods and the standard outbound shipping. Where you chose a more expensive delivery service, we refund the standard rate.
- Return postage is at your cost unless the goods are defective or we sent the wrong item, in which case we pay it.
- A shoe that has become too small is not a defect. Feet grow; that is the premise of the whole shop. It is, however, exactly what the 14-day withdrawal period and the exchange process are for if the pair never fitted in the first place.
11. Legal guarantee
Goods sold to consumers carry the Portuguese legal guarantee of conformity of 3 years from delivery, with a presumption in your favour during the first 2 years. Remedies are repair, replacement, a price reduction or termination, in the order the law provides.
What counts as a defect and what does not — with worked examples — is set out on Legal guarantee.
12. Age and safety information
- Products sold from under three years old carry no laces and no removable decorative part of any kind.
- Where a product carries an attached decorative part, it has passed a 90 N pull test held for ten seconds and is marked as not suitable for children under three. That warning is repeated in the bag and again at checkout.
- Chemical restriction limits, test methods and the material composition of each pair are published on the product page and summarised on Safety and materials.
- Sizes are given as EU numbers together with the measured foot length in millimetres that each size covers. Age ranges on this site are context, not a sizing instruction.
13. Your data
We use your details to process the order, to deliver it and to meet our accounting obligations. Marketing consent is asked for separately and is never a condition of buying.
Where you give us a child’s foot length or age, that information is treated as children’s data: supplied by a parent or guardian, used only to recommend a size, kept for no more than twelve months, never used for profiling or targeted advertising, and deleted on request. We do not send reminders based on a child’s age or on when you last measured. See the privacy policy.
14. Liability
We are liable for foreseeable loss caused by our breach of these terms or our negligence. Nothing in these terms limits or excludes liability for death or personal injury caused by negligence, for fraud, or for any liability that Portuguese law does not permit us to limit or exclude — including your statutory rights as a consumer.
We are not liable for loss caused by using footwear for a purpose it is not made for, by failing to follow the care instructions on the product page, or by choosing a size that does not match the measured foot length we asked for.
15. Complaints and disputes
Write to support@poderinfantilshoes.homes or call +351 256 871 538 first: most things are settled in one message. If we have not put it right, you have the following routes, and using them costs you nothing.
- Livro de Reclamações Eletrónico — https://www.livroreclamacoes.pt/inicio. We are required to answer a complaint made there within 15 working days and to forward it to the competent authority.
- Alternative dispute resolution — CNIACC — Centro Nacional de Informação e Arbitragem de Conflitos de Consumo, https://www.cniacc.pt, Rua D. Afonso Henriques, 1, 4700-030 Braga, Portugal, geral@cniacc.pt, +351 253 619 107. CNIACC has national jurisdiction on a supplementary basis and covers the district of Aveiro, where our registered office is located.
- EU Online Dispute Resolution platform — https://ec.europa.eu/consumers/odr.
- Consumer authorities: DGC — Direção-Geral do Consumidor and ASAE — Autoridade de Segurança Alimentar e Económica.
16. Governing law and changes
These terms are governed by Portuguese law. Nothing here deprives a consumer of the protection of mandatory rules of the country in which they habitually reside.
We may change these terms. The version that applies to your order is the one published when you placed it, and the date at the top of this page tells you when it last changed.
If any provision is found unenforceable, the rest continues to apply.
